The following terms and conditions set out the basis on which all non-training dives and trips are sold by Dive Academy Ltd to the Diver from our websites, by telephone or in person at Dive Academy.
By making a booking via. this website, over the telephone or in person you agree that these terms and conditions will apply to your dive/trip and you agree to be bound by them. Please read these terms and conditions carefully.
Booking
1) Bookings are confirmed only upon receipt of full payment for the dive/trip
2) It is the responsibility of the diver to ensure that they are qualified and competent for the dives to be undertaken. In the event of the diver being unable to participate in a dive due to insufficient qualifications no refund will be available.
3) Dive Academy will provide details of depths and qualifications required for all dives/trips.
4) Divers may not participate in in-water activities without a completed medical statement. Medical statements are valid for one year, unless a change to the answers occur during this period.
5) Divers should not book onto a dive/trip without ensuring that they have the correct medical clearance.
Cancellation by the customer
6) As is standard with UK diving, once booked it is not possible to cancel/refund the dive fee. Places on dive trips may be transferred to another diver qualified for the planned depths after consulting Dive Academy staff to check if there is a waiting list. If there is a waiting list Dive Academy reserves the right to only allow transfer to the next diver on the waiting list.
Cancellation by Dive Academy
7) Dives/trips rely on minimum numbers, should these not be achieved we may move the date of the trip to another date. Customers have the option to receive a refund of monies paid or to move their booking to the rescheduled date.
8) If dives are cancelled by the operator due to bad weather, illness, mechanical breakdown or other unforeseen circumstances the customer has the option to receive a refund of monies paid or move their booking to a reschedule date or future dive/trip.
9) Dive Academy cannot be held liable for any loss incurred by the customer for transport/accommodation costs. We recommend that all customers take out suitable insurance for any trips booked.
Fitness to dive
10) Divers should be fit to participate in dives on the scheduled day. For the avoidance of doubt, divers should not be under the influence of alcohol or drugs and should be well rested and ready to participate.
11) If divers are unable to participate due to ill health or are prevented from participating due to concerns raised by Dive Academy/boat staff, refunds will not be available.
Administration and jurisdiction
12) Dive Academy will keep such personal information about the diver as is required to deliver the dive/trip. The diver consents to the keeping and processing of such personal information in either paper or electronic formats in the discretion of Dive Academy, and in accordance with our Privacy Policy which is available on request.
13) In the event that a diver wishes to complain, in the first instance this should be addressed to the Training and Operations Director at Dive Academy, 7/8 Boundary Avenue Commerce Park, Yeovil, BA22 8UU.
14) These terms and conditions and any dispute or claim arising from them shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
15) Headings within these terms are for information only and do not form part of the terms. Where any term is found to be invalid or unenforceable, all other terms will remain in force.
